1. About OfferSpot
OfferSpot helps users discover local offers and merchant promotions. Features may include nearby offers, merchant profiles, Deal of the Day (DOTD), community or social-cause listings, and optional promotional games. Features may change, be limited, or be unavailable in some locations or app versions.
2. Eligibility and accounts
You must provide accurate information when creating or maintaining an account and keep your sign-in credentials secure. You are responsible for activity carried out through your account, except where applicable law provides otherwise. Do not impersonate another person, create misleading accounts, or use the service unlawfully. Contact support promptly if you suspect unauthorised access.
3. Customer use
- Browsing OfferSpot and discovering offers is intended to be free for customers.
- Offer details, availability, prices, redemption conditions, and validity periods are provided by the relevant merchant and may change. Check the terms with the merchant before relying on an offer.
- Unless an offer expressly states otherwise, OfferSpot does not guarantee that a merchant will honour an offer or that a listed product or service will remain available.
- You must not misuse the app, manipulate participation systems, submit false information, harass others, or attempt to interfere with service security or availability.
4. Merchant accounts and responsibilities
Merchants must provide accurate business, contact, location, pricing, offer, and promotional information and must have the rights and permissions needed to publish any submitted text, logo, photograph, video, or other content. Merchants are responsible for complying with applicable consumer-protection, advertising, tax, licensing, product-safety, and other legal requirements relevant to their business and promotions.
Merchants must clearly state material conditions, exclusions, eligibility requirements, dates, stock or quantity limits, redemption steps, and any other restrictions that apply to an offer. Merchants must honour valid offers according to the conditions they publish, subject to applicable law.
5. Content review and approval
CMS may review, reject, limit, pause, or remove an offer, merchant profile, image, campaign, or other submission if it appears inaccurate, unlawful, misleading, unsafe, inappropriate, or inconsistent with these Terms or our policies. Approval or publication is not an endorsement, verification of every claim, or guarantee of a merchant's products, services, solvency, or conduct.
Some features or campaign types, including DOTD where enabled, may require additional review or approval before publication. Submission does not guarantee approval, reach, engagement, or a particular business result.
6. Merchant fees and payments
OfferSpot customer browsing is intended to be free. Merchants may be charged a fee to post, promote, or access certain business features when those paid services are enabled. Applicable prices, taxes, payment timing, and service details should be shown to the merchant before payment or otherwise communicated through the applicable merchant flow.
Merchant payments may be processed through a third-party payment gateway or UPI payment app when that option is enabled. Payment processing is subject to the provider's terms. Do not share your UPI PIN, payment-app password, or one-time password with CMS or any person claiming to be OfferSpot support. A payment confirmation, failed payment, refund, or reversal is subject to verification with the relevant provider.
Do not assume a paid service is active until the app or an authorised CMS communication confirms the relevant status. Do not pay through unofficial links or personal accounts unless the official merchant payment flow expressly identifies that method.
7. Refunds and cancellations
Merchant posting or promotion fees, if charged, are subject to the separate Refund & Cancellation Policy and any terms shown at the time of purchase. Eligibility may depend on whether the service was activated or delivered, whether a duplicate or incorrect charge occurred, and applicable law. Nothing in these Terms limits rights that cannot legally be excluded.
8. Merchant-managed games, lucky draws, and rewards
Where available, Guess & Win, lucky draws, special games, contests, or similar promotions are created or managed by the relevant merchant. The merchant is responsible for publishing clear rules, eligibility criteria, participation limits, start and end times, winner-selection method, prize or reward details, winner notification, and reward fulfilment. Customers should read the specific rules before participating.
Unless a feature's published rules explicitly state otherwise, CMS does not select winners, guarantee a prize, fulfil merchant rewards, or mediate disputes about a merchant's game or promotion. CMS may restrict or remove promotions that appear fraudulent, unlawful, misleading, or unsafe. Merchants must ensure their promotions comply with applicable laws and platform policies.
9. Direct customer-to-merchant transactions
Any purchase, booking, payment, redemption, return, warranty, or service transaction made directly between a customer and a merchant is between those parties. OfferSpot is a discovery and promotional platform and does not act as the payment intermediary for those direct transactions. The merchant is responsible for product or service delivery, pricing, receipts, returns, warranties, customer service, and fulfilment, subject to applicable law. Customers should resolve transaction questions directly with the merchant and may contact CMS about the use of the OfferSpot platform itself.
10. Community and social-cause listings
Community events and social-cause listings may be submitted by third parties. The organiser is responsible for the accuracy, safety, permissions, fundraising claims, and execution of the event. Publication by OfferSpot does not mean CMS independently verifies or endorses every organiser or claim. Do not rely on a listing without making any checks appropriate to the circumstances.
11. Prohibited use
You may not use OfferSpot to publish or distribute unlawful, fraudulent, discriminatory, threatening, defamatory, sexually exploitative, infringing, deceptive, or otherwise harmful content; impersonate a person or business; manipulate views, participation, or game results; collect personal information without authority; upload malware; reverse engineer or disrupt the service except where law permits; or violate any applicable law or third-party rights.
12. Intellectual property and submitted content
OfferSpot, its branding, software, and original materials are owned by or licensed to CMS and are protected by applicable intellectual-property laws. You may not copy, modify, distribute, or commercially exploit them except as permitted by law or with written permission.
You retain rights in content you submit. You grant CMS a non-exclusive, worldwide, royalty-free permission to host, store, reproduce, format, display, and distribute that content as reasonably necessary to operate, promote, secure, and improve OfferSpot. You confirm that you have the rights needed to grant this permission. This permission ends when the content is removed, except for copies retained for backups, legal compliance, dispute resolution, or other legitimate operational purposes.
13. Privacy
Your use of OfferSpot is also subject to our Privacy Policy, which describes how information is handled. Please review it before using the app.
14. Availability, disclaimers, and liability
We aim to keep OfferSpot available and accurate, but the service may be interrupted, changed, or unavailable because of maintenance, connectivity, third-party systems, or other circumstances. To the extent permitted by law, OfferSpot is provided on an “as available” basis. CMS does not guarantee uninterrupted operation, the accuracy of every third-party listing, a merchant's conduct, or any particular promotional outcome.
To the extent permitted by applicable law, CMS is not responsible for indirect or consequential losses arising from a merchant's products, services, offer, game, reward, or direct transaction. Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited. These Terms do not remove any rights available to you under applicable law.
15. Suspension and termination
CMS may suspend or restrict access, remove content, or close an account where reasonably necessary to protect users or the service, enforce these Terms, investigate suspected abuse or fraud, comply with law, or address security risks. Where appropriate and legally permitted, we may provide notice and an opportunity to resolve the issue. You may stop using OfferSpot at any time and request account deletion using the app's available option or the Account Deletion page.
16. Changes to OfferSpot or these Terms
We may change features or update these Terms to reflect product, business, security, or legal changes. The updated version will be published on this page with a revised “Last updated” date. If a change materially affects users, we will provide notice where required by law. Continued use after the effective date of updated Terms indicates acceptance to the extent permitted by law.
17. Governing law and disputes
These Terms are governed by the laws of India, subject to mandatory consumer-protection rules and other rights that apply to you. Disputes will be handled by the competent courts or authorities under applicable law. Nothing in this section takes away a right that cannot legally be waived.
